Legal expenses insurance, sometimes known as legal costs insurance, is designed to provide insureds with access to legal advice for business matters and coverage for the legal costs of pursuing or defending legal action. It may help SME businesses deal with unexpected legal issues not covered by their other insurance policies. It is, however, intended to complement, not substitute, core insurance cover such as professional indemnity and general liability.

As a commercial legal expenses insurance policy, Solution’s Commercial Legal Protection, responds to matters arising from the insured’s core business activities. Cover, therefore, does not extend to their private or personal legal expenses.

Unlike professional indemnity (PI), which is triggered when allegations of negligence are made against the insured, Solution’s legal expenses insurance policy, Commercial Legal Protection (CLP) covers legal costs to defend and pursue claims where professional negligence is not involved, for example pursuing payment of an unpaid invoice or defending an allegation of poor product quality or workmanship.
CLP is a standalone legal expenses insurance policy, designed to complement, not replace PI (or general liability/management liability)
Free legal advice is also available without a policy trigger and is not limited to the scope of the policy coverage, allowing the insured to access professional advice in advance of issues arising and/or mitigate rather than merely respond to a dispute or problem.

The purpose of the free legal advice service is to help and support SME businesses avoid potential issues and safeguard themselves against legal action. The advice service cannot prevent an action being brought against the insured, but it can assist to ensure that the insured is able to comply with their contractual, legal and regulatory obligations. This is likely to help make matters arising more winnable or defendable, ensuring the policy is able to respond.
Contact with the legal advice service is entirely independent of the insurance coverage and is not claim under the insurance, thus advice line usage is not recorded in the claims experience.
